Please read these Terms of Service („Terms“, „Terms of Service“) carefully before using the MAYQIVISIONS website (the „Service“) operated by [Your Name / MAYQIVISIONS] („us“, „we“, or „our“).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Services Provided

MAYQIVISIONS offers professional photography services, including but not limited to:

  • Personal Branding
  • Corporate & Event
  • Family & Kinder
  • Love Stories
  • Photography course

All services are subject to a separate written agreement or contract (the „Service Agreement“) executed between MAYQIVISIONS and the client. These Terms of Service complement, but do not replace, any specific Service Agreement. In case of a conflict between these Terms and a Service Agreement, the Service Agreement shall prevail.

2. Client Responsibilities

As a client engaging our services, you agree to:

  • Provide accurate and complete information required for the service.
  • Adhere to agreed-upon schedules and timelines.
  • Make timely payments as specified in the Service Agreement.
  • Cooperate with us during the photography sessions.
  • Ensure necessary permissions are obtained for photography on private property or involving individuals, other than those directly contracting our services.

3. Pricing and Payments

  • Specific pricing for services will be detailed in the individual Service Agreement or a separate quote provided to you.
  • Payment terms, including deposit requirements, payment schedule, and accepted payment methods, will be clearly outlined in the Service Agreement.
  • Unless otherwise agreed, a non-refundable deposit of [e.g., 25-50]% of the total service fee is required to secure your booking and is due upon signing the Service Agreement.
  • All prices are subject to applicable taxes.
  • Overdue payments may incur late fees as specified in the Service Agreement.

4. Booking, Rescheduling, and Cancellations

  • Booking: Services are considered booked and confirmed only upon receipt of the signed Service Agreement and the required deposit.
  • Rescheduling: Requests for rescheduling must be made in writing [e.g., at least 72 hours] prior to the scheduled service date. Rescheduling is subject to our availability.
  • Cancellations:
    • If you cancel [e.g., more than 14 days] before the scheduled service date, [e.g., the deposit may be retained, but no further payment is due].
    • If you cancel [e.g., within 14 days] of the scheduled service date, [e.g., the full service fee may be due, or a higher percentage of the fee].

  • Our Cancellation: In the unlikely event that we must cancel a service due to unforeseen circumstances (e.g., illness, equipment failure), we will offer to reschedule the service or provide a full refund of any payments made.

5. Copyright and Usage Rights

  • Ownership of Copyright: Unless otherwise explicitly stated in the Service Agreement, MAYQIVISIONS retains all copyrights to all photographs created during the provision of our services.
  • Client Usage Rights: Upon full payment for the services, clients are typically granted a [e.g., personal, non-commercial] license to use the delivered photographs for [e.g., personal display, sharing with friends and family, personal social media].
    • Any commercial use, resale, or extensive public display beyond the agreed-upon personal license requires a separate written agreement and may incur additional licensing fees.
  • MAYQIVISIONS‘ Usage Rights: You agree that MAYQIVISIONS may use the photographs for our own portfolio, marketing, and promotional purposes (e.g., on this website, social media, print materials) unless a specific exclusion is agreed upon in writing in the Service Agreement (e.g., for privacy or confidentiality reasons). We will always respect client privacy and avoid revealing sensitive details.

6. Delivery of Photographs

  • The agreed method of delivery (e.g., online gallery, USB drive, prints) and estimated delivery timelines will be specified in your Service Agreement.
  • Photographs will generally be delivered in [e.g., high-resolution JPG] format unless otherwise agreed. Raw files (CR2, NEF, etc.) are generally not provided.

7. Limitation of Liability

  • In the unlikely event of photography failure (e.g., equipment malfunction, file corruption, acts of God) resulting in the inability to deliver photographs, our liability shall be limited to a full refund of all monies paid for the service. We are not responsible for any other direct or indirect damages.
  • We make no guarantees regarding specific outcomes or artistic interpretation beyond what is agreed upon in the Service Agreement.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of MAYQIVISIONS and its licensors. The Service is protected by copyright, trademark, and other laws of both the Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MAYQIVISIONS.

9. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by MAYQIVISIONS.

MAYQIVISIONS has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that MAYQIVISIONS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

10. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

12. Changes To Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
